Agreement to Terms

By downloading, installing, accessing, or using Sudoku Breeze ("the App", "our App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms constitute a legally binding agreement between you and Sudoku Breeze ("we", "us", "our"). We reserve the right to modify these Terms at any time, and your continued use of the App constitutes acceptance of any changes.

Description of Service

Sudoku Breeze is a mobile application designed to provide an enjoyable Sudoku puzzle experience. The App provides:

• Puzzle Generation: Locally generated Sudoku puzzles using the Las Vegas algorithm, with no internet required.
• Multiple Difficulty Levels: Five difficulty levels—Easy, Medium, Hard, Expert, and Insane.
• Interactive Gameplay: Pen mode for final answers and Pencil mode for notes.
• Move History: Unlimited Undo/Redo functionality (up to 500 moves).
• Mistake Tracking: Track errors with a limit of 3 mistakes per game.
• Timer: Game timer with pause/resume functionality.
• Hints System: Get hints when you're stuck (may require watching ads in free version).
• Theme Options: Light and Dark modes.
• Auto-Save: Automatic game saving and progress restoration.
• Statistics: Track your performance across difficulty levels.

Eligibility

You must be at least 13 years old to use this App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18 years old, you must have your parent or legal guardian's permission to use the App.

User Responsibilities

Fair Play

• You agree to use the App in a fair manner and not attempt to exploit the puzzle generation or hint systems.
• You should not use external tools, scripts, or automated systems to solve puzzles or circumvent game mechanics.

Software Integrity

• You agree NOT to reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
• You agree NOT to modify, adapt, translate, or create derivative works based on the App.
• You agree NOT to remove, alter, or obscure any copyright, trademark, or other proprietary rights notices.

Local Data Responsibility

• You are responsible for your own data stored on your device.
• If you delete or reinstall the App, local statistics and saved games will be lost, as there is no cloud sync.
• We recommend keeping the App installed if you want to preserve your game progress and statistics.

Free and Premium Features

Free Version

The free version of Sudoku Breeze includes:

• Full access to all difficulty levels and gameplay features
• All game modes (Pen, Pencil, Undo/Redo)
• Statistics and progress tracking
• Theme options (Light/Dark)
• Banner ads displayed during gameplay
• Interstitial ads shown after completing games
• Rewarded video ads to earn hints

Premium Upgrade

A one-time in-app purchase ("Sudoku Breeze Premium") is available that provides:

• Ad-Free Experience: All banner and interstitial advertisements are removed.
• Premium Features: Access to any additional premium features added in the future.
• One-Time Payment: No recurring subscription—pay once, own forever.

Purchases, Billing, and Refunds

Payment Processing

• All purchases are processed through Apple App Store (iOS) or Google Play Store (Android).
• Payment will be charged to your Apple ID or Google Play account upon confirmation of purchase.
• We do not process payments directly and do not have access to your payment information.

Restore Purchases

You can restore previous purchases on new devices or after reinstalling the App:

• Use the "Restore Purchases" option in the Settings screen.
• Restoration requires being signed into the same Apple ID or Google Play account used for the original purchase.

Refunds

• Refund Policy: All refund requests must be directed to the respective app store (Apple or Google).
• Apple App Store: Request refunds at reportaproblem.apple.com
• Google Play Store: Request refunds through Google Play support.
• No Refunds from Us: We cannot process refunds directly as we do not handle payment processing.

Third-Party Services

The App integrates with the following third-party services:

Google AdMob

The free version uses Google AdMob for displaying advertisements (banner, interstitial, and rewarded video ads). AdMob's services are subject to Google's Terms of Service.

Apple App Store and Google Play Store

Downloading and purchasing through these platforms subjects you to their respective terms and conditions:

Expo

The App is built using Expo, which is used for app updates and basic device information. Expo's services are subject to Expo's Terms of Service.

Intellectual Property Rights

Our Rights

• The App, including its design, features, functionality, graphics, logos, icons, and code, are owned by Sudoku Breeze or our licensors.
• Sudoku Breeze, the Sudoku Breeze logo, and all related names and designs are trademarks of Sudoku Breeze.
• You may not use any trademarks without our prior written permission.

License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download, install, and use the App on devices you own or control.
• Use the App for personal, non-commercial purposes.
• Access features available in your tier (free or premium).

Data and Privacy

Your privacy is important to us. Our data practices are described in detail in our Privacy Policy, which is incorporated into these Terms by reference.

Key Points:

• We do not collect or store your game data on our servers.
• All game data is stored locally on your device.
• Third-party ad providers may collect device identifiers for advertising purposes.
• We do not sell your personal data.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the maximum extent permitted by law, we disclaim all warranties, including but not limited to:

• Implied Warranties: Warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
• Performance: That the App will be uninterrupted, timely, secure, or error-free.
• Results: That the puzzles generated will be of a specific difficulty or solvable in a particular manner.
• Data Loss: That your data will not be lost, corrupted, or damaged.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF THE APP.

Types of Damages Excluded

We are not liable for:

• Direct Damages: Loss of data, loss of game progress, or device issues.
• Indirect Damages: Consequential, incidental, special, exemplary, or punitive damages.
• Third-Party Claims: Claims arising from third-party services or content (ads, app stores).

Maximum Liability

If we are found liable despite these limitations, our total liability shall not exceed the greater of:

• The amount you paid for the Premium upgrade, or
• $50 USD

Termination

Termination by You

• You may stop using the App at any time.
• You may delete the App from your device at any time.

Termination by Us

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including:

• Violation of these Terms
• Fraudulent activity
• At our sole discretion

Effect of Termination

Upon termination:

• Your right to use the App ceases immediately.
• Any data stored locally on your device will remain until you delete it.
• No refunds will be provided for the Premium upgrade, except as required by law.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Sudoku Breeze operates, without regard to its conflict of law provisions.

App Store Additional Terms

If you downloaded the App from the Apple App Store, you acknowledge and agree that:

• These Terms are between you and Sudoku Breeze, not Apple.
• Apple has no obligation to provide maintenance or support for the App.
• Apple is not responsible for addressing any claims relating to the App.
• Apple is a third-party beneficiary of these Terms and may enforce them.

If you downloaded the App from Google Play Store, you acknowledge and agree that:

• These Terms are between you and Sudoku Breeze, not Google.
• Google has no obligation or liability with respect to the App.

Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Last updated" date at the top of these Terms.
• We will notify you of material changes through the App.
• Continued use of the App after changes constitutes your acceptance of the new Terms.
• If you do not agree to the new Terms, you must stop using the App.

BY DOWNLOADING, INSTALLING, OR USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.
