Terms of Service
Agreement to Terms
By downloading, installing, accessing, or using Joy Habit Tracker ("the App", "our App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
These Terms constitute a legally binding agreement between you and Joy Habit Tracker ("we", "us", "our"). We reserve the right to modify these Terms at any time, and your continued use of the App constitutes acceptance of any changes.
Description of Service
Joy Habit Tracker is a mobile application designed to help users build and maintain positive habits. The App provides:
- Habit Creation and Tracking: Create unlimited habits (free users limited to 5 habits) with customizable names, icons, colors, and frequencies
- Progress Monitoring: Track daily completions, view streaks, and monitor habit progress over time
- Visual Analytics: View statistics, heatmaps, charts, and detailed analytics of your habit performance
- Smart Reminders: Set custom notification reminders for each habit
- Notes: Add notes to habit completions to record thoughts and context
- Data Management: Export and import your habit data for backup purposes (Premium feature)
- iCloud Sync: Synchronize your data across your iOS devices (iOS only, Premium feature)
- Archive System: Archive habits without losing historical data
- Customization: Personalize your experience with themes, user profiles, and custom settings
Eligibility
You must be at least 13 years old to use this App. By using the App, you represent and warrant that you meet this age requirement. If you are under 18 years old, you must have your parent or legal guardian's permission to use the App.
Account and Data
Your Responsibility
- You are solely responsible for all habits, data, and content you create within the App
- You must provide accurate information when using the App
- You are responsible for maintaining the security of your device and any data stored on it
- You should regularly back up your data using the export feature
Data Storage
- Local Storage: By default, all your habit data is stored locally on your device using secure storage methods
- No Account Required: The App does not require you to create an account or provide personal information
- Your Data: You own all the data you create in the App
- No Server Access: We do not have access to your personal habit data stored locally on your device
iCloud Sync (iOS Only)
- If you enable iCloud sync, your data will be stored in your personal iCloud account
- iCloud sync requires an active iCloud account and sufficient iCloud storage space
- Data synced to iCloud is subject to Apple's iCloud Terms and Conditions
- We do not have access to data stored in your iCloud account
- You can disable iCloud sync at any time through the App settings
Free and Premium Features
Free Plan
The free version of the App includes:
- Up to 5 active habits
- Basic habit tracking and completion recording
- Streak tracking and basic statistics
- 1 reminder per habit
- Local notifications
- Light and dark themes
Premium Plans
Premium access unlocks additional features:
- Unlimited Habits: Create as many habits as you want
- Advanced Statistics: Detailed analytics, charts, and insights
- Multiple Reminders: Set multiple reminder times per habit
- Data Export/Import: Backup and restore your data in CSV or JSON format
- iCloud Sync: Synchronize data across your iOS devices (iOS only)
- Priority Support: Get help faster when you need it
- Ad-Free Experience: Enjoy the App without interruptions
Premium Subscription Options
We offer three premium purchase options:
- Monthly Subscription: Recurring monthly subscription, automatically renews
- Yearly Subscription: Recurring annual subscription, automatically renews (best value)
- Lifetime Purchase: One-time payment, never expires, no recurring charges
Purchases, Billing, and Refunds
Payment Processing
- All purchases are processed through Apple App Store (iOS) or Google Play Store (Android)
- Payment will be charged to your Apple ID or Google Play account upon confirmation of purchase
- We do not process payments directly and do not have access to your payment information
- All purchases are managed by RevenueCat, our subscription management service provider
Subscriptions
- Automatic Renewal: Subscriptions (Monthly and Yearly) automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
- Renewal Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period
- Pricing: Subscription prices are displayed in the App and may vary by region
- Price Changes: We reserve the right to change subscription prices with notice. Changes apply to new subscriptions and renewals after the notice period
Managing Subscriptions
- Auto-Renewal: Turn off auto-renewal at any time through your device's account settings
- iOS: Settings > [Your Name] > Subscriptions
- Android: Google Play Store > Account > Subscriptions
- Customer Center: Access subscription management through the App's Settings screen
- Cancellation: You can cancel your subscription at any time. Cancellation takes effect at the end of the current billing period
Refunds
- Refund Policy: All refund requests must be directed to the respective app store (Apple or Google)
- Apple App Store: Request refunds at reportaproblem.apple.com
- Google Play Store: Request refunds through Google Play support
- No Refunds from Us: We cannot process refunds directly as we do not handle payment processing
- Lifetime Purchases: Lifetime purchases are generally non-refundable except as required by law or the app store's refund policy
Restore Purchases
You can restore previous purchases on new devices or after reinstalling the App:
- Use the "Restore Purchases" option in the Settings screen
- Restoration requires being signed into the same Apple ID or Google Play account used for the original purchase
Acceptable Use
You agree to use the App in compliance with all applicable laws and regulations. You agree NOT to:
Prohibited Activities
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
- Modify, adapt, translate, or create derivative works based on the App
- Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices
- Use the App for any unlawful, harmful, or fraudulent purpose
- Attempt to gain unauthorized access to any part of the App or its related systems
- Interfere with or disrupt the App's functionality or servers
- Use automated means (bots, scripts, etc.) to access the App
- Attempt to circumvent any usage limits, restrictions, or premium features
- Sell, rent, lease, or sublicense access to the App
- Use the App in any way that could harm, disable, overburden, or impair the App
- Collect or harvest any information from the App for unauthorized purposes
Consequences of Violation
Violation of these Terms may result in:
- Immediate termination of your access to the App
- Cancellation of any premium subscriptions without refund
- Legal action if violations involve illegal activities
Intellectual Property Rights
Our Rights
- The App, including its design, features, functionality, text, graphics, logos, icons, images, audio clips, video clips, code, and all intellectual property rights therein, are owned by Joy Habit Tracker or our licensors
- Joy Habit Tracker, the Joy Habit Tracker logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Joy Habit Tracker
- You may not use any trademarks without our prior written permission
- All other names, logos, product and service names, designs, and slogans mentioned in the App are the trademarks of their respective owners
Your Rights
- You retain all rights to the habit data and content you create within the App
- You grant us no rights to your personal habit data
- You may export your data at any time in standard formats (Premium feature)
License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to:
- Download, install, and use the App on devices you own or control
- Use the App for personal, non-commercial purposes
- Access features available in your subscription tier (free or premium)
This license does not allow you to:
- Use the App for commercial purposes without our permission
- Distribute or make the App available over a network
- Copy, modify, or create derivative works of the App
Third-Party Services
The App integrates with the following third-party services:

Downloading and purchasing through these platforms subjects you to their respective terms and conditions

We use RevenueCat for subscription and purchase management. RevenueCat's services are subject to their Terms of Service and Privacy Policy

Notification Services
The App uses Apple Push Notification Service (iOS) and Google Firebase Cloud Messaging (Android). These services are subject to their respective terms and conditions.
Data and Privacy
Your privacy is important to us. Our data practices are described in detail in our Privacy Policy, which is incorporated into these Terms by reference.
Key Points:
- We do not collect or store your personal habit data on our servers
- All habit data is stored locally on your device
- iCloud sync (if enabled) stores data in your personal iCloud account
- We do not sell or share your personal data with third parties

App Updates and Modifications
Updates
- We may release updates, bug fixes, and new features from time to time
- Some updates may be required to continue using the App
- Updates may change, add, or remove features
- You are responsible for keeping the App updated to the latest version
Service Modifications
- We reserve the right to modify, suspend, or discontinue any aspect of the App at any time
- We may impose limits on certain features or restrict access to parts of the App
- We will provide reasonable notice for significant changes when possible
- Modifications may be made without notice for security or legal reasons
No Guarantee of Continuity
- We do not guarantee that the App will always be available or error-free
- We may discontinue the App or premium features with reasonable notice
- In the event of service discontinuation, we will provide information about data export
Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
To the maximum extent permitted by law, we disclaim all warranties, including but not limited to:
- Implied Warranties: Warranties of merchantability, fitness for a particular purpose, title, and non-infringement
- Performance: That the App will be uninterrupted, timely, secure, or error-free
- Results: That the results obtained from using the App will be accurate or reliable
- Quality: That the quality of the App will meet your expectations
- Compatibility: That the App will work with all devices or operating systems
- Data Loss: That your data will not be lost, corrupted, or damaged
No Medical or Professional Advice
- The App is for informational and motivational purposes only
- The App is not a substitute for professional medical, psychological, or health advice
- Always seek the advice of qualified professionals for health or medical conditions
- We are not responsible for any decisions you make based on using the App
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM YOUR USE OF THE APP.
Types of Damages Excluded
We are not liable for:
- Direct Damages: Loss of data, loss of profits, loss of revenue, or business interruption
- Indirect Damages: Consequential, incidental, special, exemplary, or punitive damages
- Personal Damages: Personal injury, emotional distress, or loss of privacy
- Device Damage: Damage to your device or other equipment
- Third-Party Claims: Claims arising from third-party services or content
Maximum Liability
If we are found liable despite these limitations, our total liability shall not exceed the greater of:
- The amount you paid for premium features in the 12 months preceding the claim, or
- $100 USD
Exceptions
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
Indemnification
You agree to indemnify, defend, and hold harmless Joy Habit Tracker, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:
- Your use or misuse of the App
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Your violation of any applicable laws or regulations
- Content or data you provide through the App
Termination
Termination by You
- You may stop using the App at any time
- To cancel subscriptions, follow the instructions in the "Managing Subscriptions" section
- You may delete the App from your device at any time
- Uninstalling the App does not automatically cancel subscriptions
Termination by Us
We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including:
- Violation of these Terms
- Fraudulent activity
- At our sole discretion
Effect of Termination
Upon termination:
- Your right to use the App ceases immediately
- You must delete the App from all devices
- Any data stored locally on your device will remain until you delete it
- No refunds will be provided for unused subscription periods, except as required by law
- Sections of these Terms that should survive termination will remain in effect
Dispute Resolution
Informal Resolution
Before filing a formal claim, you agree to contact us at joyfulmind96@gmail.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 30 days of submission, you may bring a formal proceeding.
Binding Arbitration
Any dispute arising out of or relating to these Terms or the App shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for intellectual property infringement or other equitable relief.
Arbitration Rules:
- Arbitration will be conducted by a neutral arbitrator
- The arbitration will take place in English
- Each party will bear its own costs and expenses
- The arbitrator's decision will be final and binding
Class Action Waiver
You agree to bring claims only in your individual capacity and not as a plaintiff or class member in any class or representative action. Class arbitrations, class actions, and representative actions are not permitted.
Exceptions
You may opt out of binding arbitration and the class action waiver by sending written notice to joyfulmind96@gmail.com within 30 days of first accepting these Terms.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Joy Habit Tracker operates, without regard to its conflict of law provisions.
Any legal action or proceeding (except arbitration as described above) shall be brought exclusively in the courts of that jurisdiction, and you consent to personal jurisdiction in such courts.
Additional Provisions
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Joy Habit Tracker regarding the App and supersede all prior agreements and understandings.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
No Waiver
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
Assignment
You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.
Force Majeure
We shall not be liable for any failure to perform our obligations under these Terms due to circumstances beyond our reasonable control, including acts of God, war, terrorism, pandemic, riot, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
Export Control
You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce, in your use of the App.
Notices
We may provide notices to you via email (if provided), through the App, or by posting on our website. You agree that electronic notices satisfy any legal communication requirements.

App Store Additional Terms
If you downloaded the App from the Apple App Store, you acknowledge and agree that:
- These Terms are between you and Joy Habit Tracker, not Apple
- Apple has no obligation to provide maintenance or support for the App
- Apple is not responsible for addressing any claims relating to the App
- Apple is a third-party beneficiary of these Terms and may enforce them
If you downloaded the App from Google Play Store, you acknowledge and agree that:
- These Terms are between you and Joy Habit Tracker, not Google
- Google has no obligation or liability with respect to the App
Changes to These Terms
We reserve the right to modify these Terms at any time. When we make changes:
- We will update the "Last updated" date at the top of these Terms
- We will notify you of material changes through the App or via email (if provided)
- Continued use of the App after changes constitutes your acceptance of the new Terms
- If you do not agree to the new Terms, you must stop using the App
We encourage you to review these Terms periodically to stay informed about our terms and conditions.
